These Terms of Service ("Terms") govern your access to and use of the mobile application available on the Apple App Store under ID 6803128296 (the "App"), developed and operated by EXIM MARKETS LLC ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

The App is a financial utility designed to provide informational tools, calculations, and references related to personal finance. The App may also display promotional offers from partner financial institutions. The App is provided for general informational purposes only.

4. No Financial Advice

The App does not provide financial, investment, tax, legal, or accounting advice. All content, calculations, and AI-generated outputs are for informational and educational purposes only. You should consult qualified professionals before making financial decisions. We do not guarantee the accuracy, completeness, or suitability of any information presented in the App.

5. AI Analyzer Feature

The App includes an AI-powered analysis feature that uses the ChatGPT API provided by OpenAI. AI-generated responses may contain errors, omissions, or outdated information. You use the AI feature at your own risk and are solely responsible for evaluating and verifying any output before relying on it.

We do not store the content of your AI requests. Use of the AI feature is also subject to OpenAI's terms and policies.

6. Partner Offers

The App may display advertisements, links, or promotional content relating to products and services offered by partner financial institutions. Such content is provided for informational and marketing purposes.

• Display of a partner offer does not constitute an endorsement, recommendation, or guarantee by us.
• Any contract, application, or transaction with a partner is concluded directly between you and that partner under the partner's own terms.
• We are not a bank, lender, broker, or financial institution and do not provide banking or credit services.
• We may receive compensation from partners for displaying their offers. This does not affect the price you pay to a partner.

7. Acceptable Use

You agree to use the App only for lawful purposes. You must not:

• Use the App in violation of applicable laws or regulations
• Attempt to reverse engineer, decompile, or disrupt the App
• Use the App to transmit harmful code or unauthorized content
• Misrepresent AI-generated content as professional financial advice

8. Intellectual Property

All content, design, software, trademarks, and other materials in the App are owned by EXIM MARKETS LLC or used under license. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, EXIM MARKETS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the App, partner offers, or AI-generated content. Our total liability shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim.

11. Third-Party Services and Links

The App may integrate or link to third-party services, including OpenAI and partner financial institutions. We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which explains that we do not collect personal data through the App and describes how third-party services may process information.

13. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law principles. Disputes arising from or related to these Terms or the App shall be resolved by the competent courts of the Republic of Kazakhstan, unless mandatory law provides otherwise.
